Version 2026<\/strong><\/p>\n Taxi Move, with registered office at Via della Casella no. 51 \u2013 50142 Florence (FI) \u2013 VAT No.\/Tax Code 07300420481, owns and operates the software application known as TAXI MOVE (hereinafter also referred to simply as the \u201capplication\u201d or \u201capp\u201d), designed for mobile devices, compatible with both iOS and Android operating systems, and available for free download by Users on smartphones connected to the Internet.<\/p>\n The app enables Users to request or book passenger transportation services by taxi, provided by drivers holding a valid licence or authorisation, who provide transportation services independently and under their own responsibility. The purpose of the service offered through the application is to connect the requesting User with the driver, either directly or through the taxi companies to which the drivers belong, by means of the application.<\/p>\n Use of the app is governed by these Terms and Conditions of Use and implies acceptance thereof; Users are therefore invited to read them carefully before using the service described herein.<\/p>\n 1.1.<\/strong> a) the User\/Customer requiring a non-scheduled public passenger transportation service (taxi);<\/p>\n b) Transportation Service Providers, namely individual taxi drivers and\/or participating taxi companies.<\/p>\n 1.2.<\/strong> 1.3.<\/strong> However, by applying such specific filters, the User acknowledges that vehicles with the requested characteristics may not be available at the time of the request, without prejudice to the possibility of requesting another taxi with standard characteristics.<\/p>\n 2.1.<\/strong> 2.2.<\/strong> a) the proper performance, quality, safety or punctuality of the taxi transportation service provided by the Transportation Service Provider;<\/p>\n b) any damage, loss, injury or dispute arising during or in connection with the transportation service.<\/p>\n Any complaints concerning the transportation service must be addressed directly by the User to the Transportation Service Provider.<\/p>\n 2.3.<\/strong> 2.4.<\/strong> 2.5.<\/strong> In any event, any liability of Taxi Move, as limited above, shall be proportionate to the value of the transportation service requested, and Taxi Move shall not be held liable for damages affecting the User\u2019s personal sphere.<\/p>\n 3.1.<\/strong> 3.2.<\/strong> Once registration has been completed, the User will receive an SMS at the mobile phone number provided containing an OTP code, which enables verification of the number and grants the User the right to use the application in accordance with the methods and terms set out herein.<\/p>\n 3.3.<\/strong> 3.4.<\/strong> 3.5.<\/strong> 4.1.<\/strong> a) the Internet connection required to use the application, according to the tariff plan of their telecommunications provider;<\/p>\n b) the technical requirements and configuration of the device, as well as the device\u2019s performance for the purposes of using the application and updating the required software.<\/p>\n 4.2.<\/strong> However, the User may be required to pay a surcharge on the fare directly to the driver where municipal administrative authorities provide for such a surcharge by law, pursuant to Article 5(1) of Italian Law No. 21\/92.<\/p>\n 4.3.<\/strong> 4.4.<\/strong> 4.5.<\/strong> 4.6.<\/strong> 5.1.<\/strong> a) provide complete and truthful personal data in accordance with the instructions provided by the application and promptly update such data;<\/p>\n b) immediately inform Taxi Move of any unauthorised use, as the User is solely responsible for maintaining the confidentiality and security of their account;<\/p>\n c) use the application in such a way as not to cause interference, overload, risks or damage to the application itself. The User must not compromise or modify, either personally or through third parties, the application\u2019s security systems.<\/p>\n 5.2.<\/strong> It is strictly prohibited to:<\/p>\n a) copy, modify, distribute or create derivative works based on the app or its content;<\/p>\n b) attempt to access, decompile or reverse-engineer the app\u2019s source code.<\/p>\n 5.3.<\/strong> The User also undertakes to indemnify and hold Taxi Move harmless against any liability towards third parties arising from improper use of the application.<\/p>\n 5.4.<\/strong> Where published content violates these rules, Taxi Move shall be entitled to remove it immediately.<\/p>\n 6.1.<\/strong> 6.2.<\/strong> 6.3.<\/strong> a) Contact data<\/strong>, to enable the Transportation Service Provider to contact the User and vice versa. This includes first name, surname, email address and mobile phone number;<\/p>\n b) Location data<\/strong>, to determine the User\u2019s pick-up location and identify the nearest Transportation Service Provider. \nTaxi Move provides a technology platform that acts exclusively as an intermediary and facilitator between:<\/p>\n
\nThrough the app, the User may request passenger transportation by taxi pursuant to Articles 1678 et seq. of the Italian Civil Code, subject to vehicle availability at the time of the request, either directly or through Taxi Move\u2019s partner radio-taxi operators. The platform enables the driver to identify the requesting User\u2019s location together with the User\u2019s personal data for identification purposes.<\/p>\n
\nThrough the application, the User requesting the transportation service may specify the type of vehicle required according to their needs by entering specific information using the dedicated filters provided within the application.<\/p>\n2. LIABILITY<\/h2>\n
\nTaxi Move is not a Transportation Service Provider. The app merely facilitates the matching of supply and demand, as well as the booking and payment of the service. The transportation service contract is entered into directly between the User and the individual Transportation Service Provider.<\/p>\n
\nTaxi Move assumes no liability and shall not be held responsible for:<\/p>\n
\nThe User must personally verify, under their own responsibility, the accuracy of the information submitted when using the application. Taxi Move does not guarantee that the information transmitted by the User is accurate and complete or that it will reach the driver providing the service within the expected timeframe.<\/p>\n
\nThe User acknowledges that, in the event of the application being unavailable or malfunctioning, they may still access taxi transportation services through other alternative channels and must therefore take appropriate action in this regard, also pursuant to Article 1227 of the Italian Civil Code. Should any damage occur as a result of incorrect, incomplete or delayed transmission of information, or due to the unavailability or malfunction of the application, Taxi Move shall be liable only in cases of wilful misconduct or gross negligence.<\/p>\n
\nShould the application or data transmission interfere with or damage the User\u2019s hardware or software, Taxi Move shall be liable only in cases of wilful misconduct or gross negligence. Taxi Move shall not be liable for any loss of the User\u2019s data, as data security and backup are the User\u2019s responsibility.<\/p>\n3. REGISTRATION AND USE OF THE APP<\/h2>\n
\nTo use the app, the User must be at least 18 years of age and have full legal capacity to enter into contracts. The app must be used in compliance with Italian law and any applicable local regulations.<\/p>\n
\nIn order to use the service provided through the application, the User must download the application free of charge and complete the registration process. Registration requires the creation of an account and the provision of personal data (first name, surname, email address and mobile phone number).<\/p>\n
\nThe User undertakes to provide truthful, accurate and complete information and to keep such information up to date. The User is solely responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.<\/p>\n
\nTaxi Move reserves the right to suspend, temporarily or permanently, the User\u2019s access to the app or to discontinue the service, in whole or in part, at any time and for any reason, including failure to comply with these Terms, without any obligation to provide prior notice to the User.<\/p>\n
\nBy registering and installing the application, the User does not acquire any right to the continuous, uninterrupted and efficient availability of the application, being aware that, should the application be unavailable or malfunction, taxi transportation services may still be accessed through other alternative channels.<\/p>\n4. BOOKING AND PAYMENT SERVICES<\/h2>\n
\nThe services provided by the application do not include, and the requesting User therefore remains responsible for:<\/p>\n
\nDownloading the application and submitting individual requests through the application are provided to the User free of charge by Taxi Move, and no payment shall be due to Taxi Move in this respect.<\/p>\n
\nThe app provides the option of viewing an estimated fare and either calling a taxi immediately or booking one for a later time. The estimate is indicative only, and the final cost of the service shall be the amount actually determined by the taximeter and\/or the applicable municipal fares.<\/p>\n
\nThe app allows the use of various electronic payment methods or, where applicable, direct payment to the Transportation Service Provider. Electronic payments are processed by third-party services. Taxi Move does not store complete credit card details or the complete details of other payment instruments.<\/p>\n
\nThe User may cancel a booking in accordance with the procedures and any applicable terms, including cancellation fees, specified within the app.<\/p>\n
\nThe User acknowledges that cancellation conditions and the related penalties may vary according to the regulations of the local cooperative operating in the municipality in which the service is requested.<\/p>\n5. USER OBLIGATIONS<\/h2>\n
\nThe User is required to strictly comply with these General Terms and Conditions and with applicable laws. More specifically, the User is required to:<\/p>\n
\nTaxi Move grants the User a limited, non-exclusive, non-transferable and revocable licence to access and use the app and its content solely for the purpose of using the intermediary service, in accordance with these Terms.<\/p>\n
\nWhere inappropriate use by the User causes damage to third parties, the User shall be solely responsible and undertakes to indemnify and hold Taxi Move harmless against any and all claims made by third parties.<\/p>\n
\nResponsibility for content published and transmitted through the service lies exclusively with the User who publishes such content. The User is required to comply with applicable laws, standards of proper conduct and the principle of objectivity and shall hold Taxi Move harmless against any liability towards third parties.<\/p>\n6. PROTECTION OF PERSONAL DATA<\/h2>\n
\nAll personal data provided by the User shall be processed exclusively for the purposes of these Terms and Conditions and for the performance of contracts entered into, in compliance with the provisions of Italian laws on the protection of personal data, pursuant to and for the purposes of EU Regulation 2016\/679 (\u201cGDPR\u201d), Italian Legislative Decree No. 196\/2003 (\u201cPrivacy Code\u201d), measures issued by the Italian Data Protection Authority and any applicable sector-specific regulations.<\/p>\n
\nThe Data Controller is Taxi Move, as specified in the introduction. The collection, use and security of the User\u2019s personal data are described in the application\u2019s Privacy Policy.<\/p>\n
\nThe User acknowledges that, for the proper provision of the intermediary service, certain personal data must be processed, in particular:<\/p>\n
\nThe processing of data for the provision of the intermediary service and performance of the contract is based on Article 6(1)(b) of the GDPR. For additional purposes (e.g. marketing and service improvement), the User\u2019s specific consent shall be requested.<\/p>\n
\nWhere the transportation service is requested and provided in cities other than Florence through partners affiliated with the App, the data necessary for the performance of the service shall be transmitted to the local radio-taxi dispatch centres with territorial jurisdiction, which shall act as independent Data Controllers in relation to the transportation service provided.<\/p>\n
\nIn accordance with Articles 15\u201322 of the GDPR, the User has the right to access their personal data, request rectification or erasure thereof, restrict processing, object to processing and request data portability. These rights may be exercised by contacting the Data Controller using the contact details provided in the Privacy Policy.<\/p>\n7. INTELLECTUAL PROPERTY<\/h2>\n
\nAll intellectual property rights relating to the app, the \u201cTAXI MOVE\u201d trademark and the content available therein (texts, graphics, software, etc.) are the exclusive property of Taxi Move or its licensors.<\/p>\n8. GOVERNING LAW AND JURISDICTION<\/h2>\n
\nThese Terms shall be governed by Italian law.<\/p>\n
\nAny dispute arising out of or in connection with these Terms shall be subject to the exclusive territorial jurisdiction of the Court of Florence, without prejudice to the jurisdiction of the competent court of the consumer (User), where applicable under the relevant legislation.<\/p>\n
\nAny disputes concerning the physical transportation service shall fall within the jurisdiction of the competent court applicable to the local Transportation Service Provider, and any related complaints shall be addressed to that Provider.<\/p>\n9. AMENDMENTS TO THE TERMS<\/h2>\n
\nTaxi Move reserves the right to amend these Terms at any time. The User shall be informed of any such amendments by notification through the app or by email.<\/p>\n
